Fired for no reason

When I was looking trough unit 8: employment law, the first thing I thought about, was that a lot of people are fired for no reason. This is better known as unfair dismissal.

Jessica Maciel who is 20-years old and a single woman had to deal with an unexpected pregnancy. As it wasn’t difficult enough she got also fired because of her pregnancy.
She was four months pregnant when she started working as a receptionist at the salon named Nino D’Arena in Mississauga in August 2008.
She didn't mention her pregnancy during her job interview, knowing that if she exposed that information, she wouldn't have gotten the job. When she started her first day working she wanted to be honest with her boss and so she told her about the pregnancy. Fifteen minutes later she was asked to leave the salon.
The next day her boss called to tell her she was fired. Jessica went to the The Human Rights Tribunal of Ontario to accuse the salon. The Tribunal agreed with her and they awarded her $35,000 in damages and lost wages more than a year. Jessica says that the decision isn’t just her victory, she just want to give other woman in a similar situation the strength to fight for what they deserve.

I think that not one employer has the right to unfairly fire people. In our world it happens a lot and most people aren’t aware of those situations. What happened to Jessica isn’t unique, but it is illegal. I hope that people who are really fired for no reason will stand up for their rights.

  2. I do not agree with Lisa and Jolien. When you have a job interview, the employer expects that you are honest about everything. Not telling that you are pregnant is unacceptable. That is not a little detail that you happen to forget on your job interview. What relationship do you start with your employer when you lie from minute one? Jessica Maciel must have told her future boss that she was pregnant when she did the job interview. It is up to the employer to decide whether she can work for him or not.

  3. I agree with both opinions. There must be honesty in a worksituation, but I think it is a little bit overstated to fire someone because of not telling a pregnancy. Other punishments or solutions are possible.
